The seller is responsible for the cargo in transit only in China.

In case of the weight, dimensions, quality, quantity, type of package and sanitary standards of the goods do not confirm to the contractual ones, the seller is responsible for it (except for the responsibility born by the Insurance Company and transporation companies), during 15 days since the cargo reached the place of destination, the buyer has right to lay a claim to the Seller and to demand the replacement of the cargo on the basis of written expert judgment made by Chamber of Commerce and Industry of the buyer's country. The acceptance of the cargo after coming to warehouse may, by the buyer's wish be performed in the presence of the seller's representative. The cost of his trip, including visas, invitation, airflight, hotel (at least ***) and travel allowance of 6 th.rubles a day, is 30 thousand rubles. The trip of the seller's representative is paid by the Buyer.

On producing such a document the corresponding party bears no responsibility for the consequences of the force major and then the question of the contract prolongation or termination can be settled.

The Arbitration process will take place at the defendant's country. At the territory of PR China the arbitrage hearing will take place in International Economic and Trade Arbitration Committee attached to CCPIT in Beijing, in accordance with the procedures of this Committee.
